These Terms and Conditions of Use and Sale (“Terms”) govern your access to and use of www.aboveallpeptides.com (the “Site”) and your purchase of any product offered through it. They form a binding agreement between you (“you,” “User,” or “Customer”) and Above All Peptides (“Above All Peptides,” “we,” “us,” or “our”).
These Terms incorporate our Privacy Policy and Shipping Policy by reference.
By accessing the Site, creating an account, or placing an order, you accept these Terms in full. If you do not agree to any part of them, do not use the Site and do not place an order.
1. Products Are for Laboratory Research Use Only
ALL PRODUCTS SOLD BY ABOVE ALL PEPTIDES ARE SUPPLIED STRICTLY FOR IN-VITRO LABORATORY RESEARCH USE ONLY.
PRODUCTS ARE NOT FOR HUMAN CONSUMPTION, HUMAN USE, VETERINARY USE, DIAGNOSTIC USE, THERAPEUTIC USE, CLINICAL USE, OR ANY USE IN OR ON THE BODY OF A HUMAN OR ANIMAL, UNDER ANY CIRCUMSTANCE, IN ANY FORM, UNDER ANY CONDITION.
Products are intended exclusively for qualified researchers and laboratory professionals working in appropriately equipped laboratory settings. Products are not drugs, foods, food additives, beverages, dietary supplements, nutritional or health products, cosmetics, or medical devices, and must not be used or presented as any of those things.
Products must not be combined, mixed, diluted, reconstituted, repackaged, relabeled, or otherwise prepared for consumption by or administration to any human or animal, for any reason.
No product offered on the Site has been approved, cleared, licensed, or authorized by the United States Food and Drug Administration or any other regulatory authority, in any jurisdiction, for any use — including for the prevention, treatment, diagnosis, mitigation, or cure of any disease, ailment, or medical condition.
No product is the subject of an approved application under section 505 of the Federal Food, Drug, and Cosmetic Act (“FD&C Act”), 21 U.S.C. § 355, or of an approved Investigational New Drug application. Products are not manufactured under current Good Manufacturing Practice requirements for finished pharmaceuticals, and we make no representation of compliance with any pharmacopeial monograph.
3. No Medical Claims; No Medical Advice
Above All Peptides makes no claim, representation, warranty, or suggestion — express or implied — that any product diagnoses, cures, mitigates, treats, or prevents any disease or condition; affects the structure or any function of the human or animal body; is safe or effective for any use in humans or animals; or confers any health, cosmetic, performance, or aesthetic benefit.
Nothing on the Site constitutes medical advice, a medical opinion, a recommendation, or a statement of fact about any health outcome. Information on the Site is provided solely as scientific and bibliographic reference material for researchers evaluating compounds for laboratory investigation.
Statements describing third-party published literature are not adopted by us, are not claims about the products we sell, and must not be construed as guidance for any use in humans or animals.
4. No Dosing, Administration, or Protocol Guidance
Above All Peptides does not provide, and will not provide upon request:
- dosing, dose ranges, or dose calculations;
- reconstitution, dilution, or preparation instructions for use in or on a body;
- administration or injection guidance, or routes of administration;
- cycling, stacking, tapering, or protocol guidance;
- guidance on combining any product with any other product, drug, or substance.
Requests for such information will be declined. Our personnel are not authorized to provide it. Any statement by any employee, agent, or contractor purporting to provide it is unauthorized, falls outside the scope of their authority, does not bind us, and does not alter the intended use of our products.
Above All Peptides does not sell, bundle, cross-sell, recommend, or supply syringes, needles, or any other item used to prepare or administer a substance to a human or animal, and we do not direct customers to any source for such items.
You must be at least 21 years of age to use the Site or to purchase any product. We do not knowingly permit access or sales to anyone under 21, and we may require proof of age at any time.
7. Customer Eligibility, Representations, and Warranties
By placing an order, you represent, warrant, and covenant that each of the following is true and will remain true:
(a) You are at least 21 years of age and have legal capacity to enter into this agreement.
(b) You are a qualified researcher, laboratory professional, or authorized purchasing agent for a research institution, commercial laboratory, university, or other entity engaged in bona fide scientific research, and you are duly capable, authorized, and where applicable licensed to handle the products you order.
(c) You possess the scientific training, technical knowledge, facilities, and equipment necessary to handle, store, use, and dispose of research chemicals safely.
(d) You are acquiring products solely for in-vitro laboratory research and for no other purpose.
(e) You will not consume, ingest, inject, inhale, apply, or otherwise administer any product to yourself, to any other human, or to any animal.
(f) You will not resell, redistribute, repackage, relabel, or transfer any product to any person for human or animal consumption or use.
(g) You have independently researched and satisfied yourself as to: the intended laboratory research use of the products; all safety and health hazards associated with the products and their handling; and all regulatory and legal considerations governing your purchase, possession, and use of the products in your municipality, state, and country.
(h) You will not alter, adulterate, or misbrand any product within the meaning of the FD&C Act, and you will not introduce any product into interstate commerce in violation of sections 301, 501, 502, 505, or 512 of the FD&C Act.
(i) Before manufacturing, marketing, or distributing anything derived from or incorporating a product purchased from us, you will ensure it has been fully examined and tested to meet all applicable efficacy and safety standards required by law, by appropriately qualified and authorized personnel.
(j) You will independently verify all dangers and hazards associated with any product before use.
These are material terms. We rely on them in deciding whether to accept your order.
You may not use any product for any purpose other than in-vitro laboratory research. Without limitation, the following are prohibited: any use in or on the body of a human or animal; any clinical, diagnostic, or therapeutic application; compounding or formulating any product for human or animal administration; resale to consumers or to any party for human or animal use; use in any food, beverage, supplement, or cosmetic product; and use in athletic or sporting competition.
We reserve the absolute right, in our sole discretion and without liability, to refuse, limit, cancel, or reverse any order in whole or in part, at any time, for any reason or no reason; to decline to sell to any person or entity; to require documentation substantiating research affiliation or qualified-purchaser status as a condition of fulfillment; to cancel any order where we have reason to believe a representation under Section 7 is false or a use under Section 8 is intended; to terminate any account; and to report suspected unlawful activity to appropriate authorities.
We do not sell into jurisdictions where the sale, import, or possession of a product is restricted or prohibited.
10. Product Information, Descriptions, and Certificates of Analysis
We endeavor to describe products accurately but do not warrant that any description, specification, image, or other content is complete, current, or error-free. We are not liable for typographical errors, inaccuracies, or omissions, and we may correct them and cancel affected orders at any time, including after an order is submitted.
Where we publish a Certificate of Analysis (“COA”) or analytical data, that documentation reports analytical findings for the identified lot only, as tested by the named laboratory on the stated date, by the stated method. A COA speaks to identity and purity as measured and nothing more. A COA is not a representation of sterility, non-pyrogenicity, endotoxin status, safety, fitness for any purpose, or suitability for use in or on any human or animal body. Products are not sterile and are not tested for sterility or endotoxins unless expressly stated for a specific lot. Results for one lot do not apply to any other lot.
11. Pricing, Availability, and Orders
All prices are in U.S. dollars and may change at any time without notice. Product availability may change without notice, and we do not guarantee that any item will be in stock.
Your submission of an order is an offer to purchase. No contract is formed until we accept your order by shipping it. An order confirmation acknowledges receipt only and does not constitute acceptance.
All sales are final. We do not accept returns or exchanges of opened or used product. Because these are research chemicals whose integrity and chain of custody cannot be verified once they leave our control, returned product cannot be restocked or resold.
Exceptions. Notwithstanding the above, contact us within [7] days of delivery if: the product you received does not match what you ordered; the product arrived damaged; or the product materially fails to conform to its published COA. Where we verify such a claim, we will, at our option, replace the product or refund the purchase price. We may require photographs, the lot number, and return of the product.
Nothing in this Section limits any right you have that cannot be waived under applicable law.
13. Shipping, Title, and Risk of Loss
Shipping terms are set out in our Shipping Policy. Title and risk of loss pass to you upon our delivery of the product to the carrier. We are not responsible for carrier delays, misdelivery, loss, theft, or damage occurring after tender to the carrier, though we will assist you in pursuing a carrier claim.
14. Your Regulatory Compliance Obligations
You are solely responsible for determining whether your purchase, import, possession, use, and disposal of any product is lawful in your jurisdiction, and for obtaining any required license, permit, or authorization.
You are responsible for safe handling, storage, transport, and lawful disposal of all products, and for compliance with all applicable occupational safety, hazardous materials, and waste disposal requirements. Products should be handled only by trained personnel using appropriate personal protective equipment.
Chemical inventory laws. Products may not be listed on the Toxic Substances Control Act (“TSCA”) Inventory. Certain research and development activities are subject to exemptions under TSCA, including 40 C.F.R. § 720.36. You are responsible for determining whether your intended activity qualifies for an exemption or requires reporting, and for complying with TSCA and any analogous chemical inventory or notification requirements in your jurisdiction.
Export control. You agree not to export, re-export, or transfer any product in violation of any applicable export control, sanctions, or customs law.
All content on the Site — including text, images, photographs, videos, logos, trademarks, service marks, graphics, product descriptions, and compiled data — is owned by or licensed to Above All Peptides and protected by intellectual property laws.
You may not use, reproduce, distribute, license, modify, alter, transfer, sell, rebroadcast, publicly display, or create derivative works from any Site content without our express prior written consent. Nothing on the Site grants you any license or right in any product, service, or content beyond the limited right to view the Site for the purpose of evaluating and purchasing products.
Compound names and third-party marks appearing on the Site are used solely to identify chemical substances and do not imply affiliation with, endorsement by, or sponsorship from any mark holder.
ALL PRODUCTS AND ALL INFORMATION ON THE SITE ARE PROVIDED “AS IS” AND “WITH ALL FAULTS,” WITHOUT WARRANTY OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABOVE ALL PEPTIDES EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SITE OR ANY CONTENT ON IT IS ACCURATE, COMPLETE, CURRENT, RELIABLE, OR ERROR-FREE, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not permit the exclusion of certain implied warranties, so some of the above may not apply to you.
You acknowledge that research chemicals carry inherent and unknown risks, that the products offered have not been evaluated for safety in humans or animals, and that you assume all risk arising from your acquisition, possession, handling, storage, use, and disposal of any product.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABOVE ALL PEPTIDES AND ITS OWNERS, DIRECTORS, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS, UNDER ANY THEORY OF LIABILITY — INCLUDING CONTRACT, STRICT LIABILITY, NEGLIGENCE, OR BREACH OF DUTY — AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, WE SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY INJURY, ILLNESS, DISABILITY, DEATH, OR OTHER HARM ARISING FROM ANY USE OF A PRODUCT IN OR ON THE BODY OF A HUMAN OR ANIMAL, OR FROM ANY USE PROHIBITED UNDER SECTION 8, OR FROM YOUR ABUSE, NEGLIGENCE, MISHANDLING, OR BREACH OF THESE TERMS — ALL SUCH USE BEING EXPRESSLY PROHIBITED AND OUTSIDE THE SCOPE OF ANY PERMITTED USE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain limitations of liability, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless Above All Peptides and its owners, directors, officers, members, managers, employees, agents, and partners from and against any and all claims, demands, suits, actions, proceedings, losses, liabilities, damages, judgments, settlements, costs, and expenses — including reasonable attorneys’ fees — brought by any third party or arising out of or relating to:
(a) your breach of these Terms, including any misrepresentation under Section 7;
(b) your use, misuse, handling, storage, transport, or disposal of any product;
(c) any use of a product in or on the body of a human or animal;
(d) your resale, redistribution, repackaging, or transfer of any product;
(e) your use of the Site;
(f) your violation of any law, regulation, or third-party right.
This obligation survives termination of your account and completion of any transaction.
20. Site Availability and Permitted Access
We aim to keep the Site available continuously, but because of the technical nature of web hosting and related services, the Site may be unavailable at any time, for any reason, without notice, for any length of time. We may also update, change, or modify the Site, which may cause interruption. You agree we are not liable for any damages arising from Site unavailability, interruption, or modification.
You may access the Site only for lawful purposes connected to evaluating and purchasing products. You may not use any automated system to access, copy, or index the Site in a manner that imposes an unreasonable load on our infrastructure; attempt to gain unauthorized access to any portion of the Site or its systems; interfere with the Site’s operation or security; or use the Site to violate any law or these Terms.
We may revise these Terms at any time by posting an updated version with a new “Last updated” date. The version in effect when you place an order governs that order. Continued use of the Site after posting constitutes acceptance of the revised Terms. We will not retroactively apply material changes to a completed transaction.
Severability. If any provision is held unenforceable by a court or other tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions shall remain in full force and effect.
No waiver. Our failure to enforce any provision is not a waiver of it, and no waiver is effective unless in writing and signed by us.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for inadequate performance to the extent caused by a condition beyond its reasonable control, including natural disaster, act of war or terrorism, riot, epidemic, labor condition, governmental action, utility failure, or internet disturbance. We are not responsible for lost or delayed shipments, supply chain disruption, backorder delays, or lost or stolen mail arising from such conditions.
Survival. Sections 1–5, 7, 8, 10, and 14–24 survive termination or expiration of these Terms.
Headings. Headings are for reference only and do not affect interpretation.
Relationship. Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Above All Peptides regarding the Site, its contents, and the products offered, and supersede all prior or contemporaneous representations, agreements, and understandings, whether written or oral, express or implied. No modification is effective unless made in writing by Above All Peptides.
When you place an order and click “I agree,” you accept these Terms, the Privacy Policy, the Shipping Policy, and all disclaimers and disclosures referenced in them.
